Do I need a solicitor to prepare my Will?

It is generally advisable to use a solicitor or to have a solicitor check a will you have drawn up to make sure it will have the effect you want (Source: Making a will – Citizens Advice). This is because mistakes can easily be made when preparing a Will if you or the person drafting your Will doesn’t have the proper knowledge to do so; and any mistakes made in or with the preparation of the Will could lead to complications after your death.

Resolving misunderstandings and disputes after your death could incur significant legal costs, which will ultimately reduce the value of your distributable estate.

This means that your beneficiaries (the people you wish to leave your estate to) may receive less than what you had intended to give them.

It also means that your nominated Executors (the people you have chosen to deal with your estate after death) may face complications and difficulties when trying to carry out your wishes. Taking the relevant legal advice from a solicitor can help avoid such issues.

What are the benefits of using a solicitor?

Qualified practicing solicitors are regulated by their professional body, the Solicitors Regulation Authority, unlike some other Will writers who may not be regulated nor qualified. All regulated solicitors must carry professional indemnity insurance. This means that the advice they give and the work they do for you is insured in the event something should go wrong. I own my home. Is it a good idea to make a Will?

It is always a good idea to make a Will. If you own property, you can specify who will inherit your house. You can also specify who can live in it after you pass away whilst ultimately leaving it to someone else.

I have children from a previous relationship. Will they be disinherited from me if I remarry?
